Your data will be used exclusively for the fulfillment of orders; you can request removal at any time by unsubscribing if you have no orders in progress

All contracts are concluded directly by registering and accessing the site corresponding to the address www.oberwerk.eu where the customer can decide to conclude the contract for the purchase of the desired product by following the instructions and procedures provided for in the cart. ORDER CONFIRMATION REQUIRED TO PURCHASE AND RELATIVE PAYMENT

These general conditions of sale are an integral part of the contract between RP Optix and the Customer, therefore the customer is required to read them online or to print and read them, before concluding the purchase procedure. Confirmation of the order therefore implies full knowledge of the same and their total acceptance.

It is advisable not to buy out-of-stock products (indicated in the availability of each item with the words "coming soon") as the supply of the same could take a time ranging from 7 days to 2 months.

Orders will be processed only with goods available.

In case of out of stock, we will contact the customer to find a solution that is convenient for both parties.

PRICES

Our company sells exclusively by mail order.

Orders can only be sent via our site. All prices displayed on our site include 22% VAT and are updated periodically, so they may be subject to change without notice.

In case of incorrect / outdated price displayed or omission of price RP Optix reserves the right to cancel the order and, in the event of prepayment, immediately refund the value of the order unless otherwise agreed between the parties.

TERMS OF PAYMENT

When completing the order form, you can choose from the following options:

Cash on delivery, only for Italian customers, up to a maximum of 700.00 euros (eighteenth century), 2% cash on delivery costs on the value with a minimum cost of 6.00 euros. We only accept cash payments.

 

SHIPMENTS

Our shipments are made for Italy and abroad by GLS express courier.

The goods are always accompanied by the relevant invoice inside the package.

Shipping costs are not included in the price of the products, unless otherwise specified and involve a cost starting from Euro 8.00 including VAT for Italy and may increase proportionally based on the volume and weight of the goods.

For the Minor Islands, San Marino, Livigno, Venice and Lagoons contact for a quote.

For smaller islands and other areas not easily served by the courier, Oberwerk reserves the right to contact the customer to request a shipping surcharge before being able to process the order. In any case, the notice is visible on the cart pages at the time of order confirmation: by validating the order, you also accept these additional shipping conditions.

For abroad there is a variable cost depending on the weight, and cost details will be provided upon contact.

On the site, once you have chosen the products and their quantities, the "order confirmation" page will still show the amount of shipping costs and the total invoice

COMPLAINTS

IMMEDIATE CHECK OF THE GOODS AS SOON AS RECEIVED IS RECOMMENDED

Claims of damaged, defective or missing goods are not accepted in any way unless reported by 24.00 on the day of receipt / collection of goods. The courier delivery time is valid.

Packages with obvious signs of damage / tampering must be collected with "RESERVE OF CONTROL" and immediately reported to our company.

WITHOUT RESERVE OF CONTROL, COMPLAINTS ARE NOT ACCEPTED, BECAUSE THE COURIER IS EXEMPTED FROM LIABILITY STARTING FROM THE REGULAR COLLECTION OF THE PACKAGE.

From the day following the collection, no complaints will be accepted for damaged, faulty or missing goods in any way.

Therefore we kindly ask our customers to have an immediate integrity check.

RETURNS - RIGHT OF WITHDRAWAL

In case of return for afterthought, the shipping costs are not refunded and you are entitled to an exchange or voucher to be used in our shop or a refund.

The shipping costs are charged to the buyer, who must send the purchased item IN PERFECT CONDITION WITHOUT SIGNS OF WEAR OR TAMPERING. In the event of damage, the repair costs and any found by inappropriate use will be withheld.

The right of withdrawal is not applicable in the case of an invoice with VAT number, and the warranty is reduced to 1 year.

For purchases with Paypal payment or credit card (on Paypal protected server) the amount to be refunded (in vouchers or exchange) will be subtracted the commission costs requested by Paypal equal to 5% of the total amount.

The new Paypal rules do not provide for the reimbursement of transaction costs.

Paypal retains all commissions from our company, consequently all refunds will be deducted by 5% in case of return. Please note that the validation of the order confirms the acceptance of these rules.

We do not accept disputes.

 

RESPONSIBILITY

RP Optix assumes no responsibility for inefficiencies attributable to force majeure such as accidents, explosions, fires, strikes and / or lockouts, earthquakes, floods and other similar events that prevented, in whole or in part, the execution of the 'sales agreement within the agreed time. The RP Optix. will not be liable to any party for damages, losses and costs incurred as a result of the failure to execute the sales agreement for the reasons mentioned above, or for damages, losses and costs incurred as a result of the use or 'impossibility to use the products purchased from RP Optix, as the customer is only entitled to a refund of the price paid, excluding any shipping costs.

Likewise RP Optix is ​​not responsible for any fraudulent or illegal use that may be made by third parties, of credit cards, checks and other means of payment, upon payment of the purchased products. RP Optix, in fact, is not able to know the buyer's credit card number at any time during the purchase procedure; at the same time RP Optix is ​​unable to check the correct and lawful origin of the credit note that is delivered by the customer upon receipt of the goods.

BUYER'S OBLIGATIONS

Once the online purchase procedure has been completed, the customer undertakes to print and / or keep these general conditions, which, moreover, he will have already viewed and accepted as an obligatory step in the purchase. , as well as the printing of the specifications of the product being purchased, and this in order to fully satisfy the condition referred to in articles 52 and 53 of Legislative Decree 206/05.

The buyer is strictly forbidden to enter false and / or invented and / or fictional data in the registration procedure necessary to activate the procedure for the execution of this sales agreement and related further communications for him; the personal data and the e-mail address must be only the real personal data and not of third parties.

If the customer, having paid by credit card, should exercise the right of withdrawal, as articulated in these general conditions, the amount to be refunded will be credited by removing the Paypal / Credit Card commission of 5%

 

CONTRACTUAL RESOLUTION AND EXPRESS TERMINATION CLAUSE

The obligations assumed by the customer in art. 2 above (Obligations of the purchaser), as well as the guarantee of the successful completion of the payment that the customer must make, are essential, so that by express agreement, the non-fulfillment by the Customer of only one of these obligations, will determine the termination by law of the contract pursuant to Article 1456 of the Italian Civil Code, without the need for judicial decision, without prejudice to the right of RP Optix to take legal action for compensation for further damage.

JURISDICTION AND COMPETENT COURT

Any dispute relating to the application, execution, interpretation and violation of the '' online '' sales agreements obtained through the website www.oberwerk.eu is subject to Italian jurisdiction; these general conditions are reported, although not expressly provided therein, in conjunction with Legislative Decree 50/92 and Legislative Decree 206/05.

For any dispute between the parties regarding this contract, it will be the exclusive competence of the Court of Lecco.

 

WARRANTY

Our products are covered by a guarantee, and any reports must be made by 24.00 on the day of receipt of the goods.

The warranty covers manufacturing defects or deviations from the technical specifications.

In case the product is defective, it is possible to return it.

PRODUCTS PURCHASED OUTSIDE THE OFFICIAL NETWORK IN EUROPE, USA OR PARALLEL IMPORTS

For assistance on products purchased outside the official network, Europe, USA or parallel imports, the product must be sent directly to the European retailer or in case of purchase in the USA directly to the US retailer. It is not excluded that upon the return of the product from a country outside Europe, you may incur payments for customs fees.

We remind customers to take this possibility into consideration.

In the event of our intervention / assistance, customs duties will be required (duty 5% + VAT 22%) in addition to the transport costs incurred by us and the costs of assistance and / or repair.

Since for the Italian Customs all imported products are subject to taxation (there is no "Zero" value), we remind you that we limit ourselves to requesting customs and shipping costs, nothing else.

For assistance with purchases from our retailers, customs duties are NOT required.

RIGHT TO EXERCISE THE RIGHT OF WITHDRAWAL PURSUANT TO D.LGS. 206/05

Pursuant to art. 64 of Legislative Decree 205/06, the consumer can exercise the right of withdrawal on new products and return the product received, in compliance with the terms and methods indicated below:

  • The Customer has the right to withdraw, without any penalty and without having to specify the reason, no later than 14 working days from delivery (the delivery date indicated on the courier's waybill is valid).

  • In case of hand delivery, Robell snc accepts the return only if the returned goods are accompanied by a written request, signed and dated on the delivery date, for the normal activation of the right of withdrawal.
  • The communication can also be anticipated via email, provided that it is confirmed by registered letter with return receipt within the following 48 hours.
  • After registered receipt, instructions for the return, address and method will be provided.
  • In case of applicability of the right of withdrawal, the Customer is required to return at his own expense all the items relating to the invoice as they are received and that is absolutely new, unused, complete with all their parts and in the original packaging (envelopes and packages ).
  • Failure to comply with these principles makes the right of withdrawal inapplicable.

As per legislation, all costs of returning the product are charged to the consumer.

To return the goods, we advise our customers to use the insured mail service that we believe is faster, safer and cheaper or the express courier service. We invite our kind Customers to collaborate with us following our procedure for sending returns and not to send us goods for which the right of withdrawal is not applicable.

In case of application of the right of withdrawal, once the goods have been received, Robell snc will issue a refund or a voucher equal to the value of the goods purchased, excluding shipping costs.

For those who purchased by credit card (through paypal circuit) or Paypal, Robell snc will issue a refund or a voucher equal to the value of the goods purchased, excluding shipping costs and Paypal commissions equal to 5% of the total amount .

Attention: If the right of withdrawal is not applicable, the collection of the goods at our office will be the responsibility of the customer.
